Newsletter Regulation

I. GENERAL PROVISIONS

1. This document (hereinafter: “Regulations”) sets out the detailed rules for the provision of the “newsletter” service of Ginza.gr 2. The Newsletter service may be used by a natural person or by a legal entity acting on behalf of a person or organizational unit without legal personality, the legislation of which provides legal capacity and has full legal capacity (hereinafter: “Recipient”). If the Customer is a natural person with limited legal capacity, if such a need arises, he agrees to legally obtain the valid consent of his legal representative to conclude an Agreement for the provision of the Newsletter service (hereinafter: “Agreement”) and to provide this consent upon request to the Service Provider, the agreement having the character of a contract usually concluded in small current affairs of everyday life. The Service Provider does not charge subscribers for the newsletter (Newsletter). 3. The use of the Newsletter service (including the conclusion of the Agreement) requires the execution by the device and by the IT system used by the Recipient, of the minimum technical requirements (1) a computer, laptop or other multimedia device with access to the Internet and in the case of the Recipients of the Newsletter service for the specific mobile phone number – mobile phone, (2) access to e-mail, (3) Internet browser: Mozilla Firefox version 17.0 and later or Internet Explorer version 10.0 and later, Opera version 12.0 and later, Google Chrome version 23.0 and later, Safari version 5.0 and later, (4) recommended minimum screen resolution: 1024×768, (5) activation of cookies and Javascript support in the browser, (6) valid / active e-mail address, (7) keyboard or other pointing device that allows the correct completion of electronic forms.

II. TERMS OF USE OF THE NEWSLETTER SERVICE

1. The Newsletter service, provided at the request of the Recipient after the conclusion of the Contract, includes:

a. receipt from Recipients who have provided the Service Provider with their email address by electronic means, including automated calling systems, commercial information about the products and services of the Service Provider and the Service Provider’s partners (whose current list is given on the Website), including in particular information about their current offer, promotions, discounts and promotional campaigns, b. receipt from Recipients who have provided the Service Provider with data including their name, surname, address, postal code, city, country, and in particular created an order or account at www.ginza.gr (hereinafter: “Website”), by mail commercial information about the products and services of the Service Provider and the Service Provider’s partners (whose current list is given on the Website), including in particular coupons or exclusive promotional offers, c. receipt from Recipients who have provided the Service Provider with their telephone number, including automated systems, commercial information about the products and services of the Service Provider and the Service Provider’s partners (whose current list is given on the Website), including in particular information about current offers, discounts and promotional campaigns.

2. Use of the Newsletter service is possible after the following steps have been completed by the Recipient:

a. providing at least the email address in the appropriate field of the Website or ticking the appropriate box for receiving commercial information from the appropriate channel. b. accepting the provisions of this Regulation by clicking on the activation link sent by the Service Provider to the email address provided by the Recipient (the moment the Newsletter service is started).

3. The Newsletter service is provided for an indefinite period of time. 4. The Recipient is specifically obliged to:

a. to provide the Service Provider with only real and all necessary data of the Service Recipient, b. to promptly update the data provided to the Service Provider in relation to the conclusion of the Contract, c. to use the services provided by the Service Provider in a manner compatible with the provisions of the applicable Regulation and without violating the rights of third parties, the provisions of the Regulation, as well as the principles of social conduct adopted, in particular the non-delivery of illegal content.

III. PROTECTION OF PERSONAL DATA

1. The Recipient’s personal data are processed by the Service Provider as a personal data controller for the provision of the Newsletter service. 2. The provision of personal data by the Recipient is optional but necessary for the use of the Newsletter service, subject to paragraph 3 below. 3. The Service Provider allows Recipients to use the Newsletter service in an anonymous manner when the email address provided by the Recipient does not allow the identification of the Service Recipient and the Service Recipient has not provided the Service Provider with other personal data. 4. The Recipient of the service has the right to access his/her personal data, including the request for a copy, a request for correction, restriction of processing or deletion of the data and opt-out of the newsletter, by transferring his/her personal data, e.g. to another controller, by filing a complaint with the President of the Data Protection Office. 5. Additional information regarding the protection of personal data is contained in the “Privacy Policy” section available on the Website.

IV. INTELLECTUAL PROPERTY OF THE SERVICE PROVIDER

Exclusive rights to all elements, including works within the meaning of the law on intellectual property and related rights of Law 2121/1993 (Government Gazette A’ 25/ 4-3-1993, as amended), made available by the Service Provider or the Service Provider’s collaborators, in particular copyrights, belong to the Service Provider or to entities with which the Service Provider has concluded appropriate agreements. The Recipient is entitled to use the aforementioned free of charge only for personal use and only for the proper use of the Newsletter service throughout the world. Use of the above in a different manner is permitted only with express prior consent granted by the entity authorized for this purpose, with written assurance of otherwise it is invalid and has no legal consequences.

V. COMPLAINTS PROCEDURE

1. The Recipient may submit a complaint regarding the Newsletter service in the form of a complaint. 2. The response to the complaint by the Service Provider shall be made immediately, no later than within 30 days from the date of its submission. 3. Complaints related to the provision of the Newsletter service may be submitted via the contact form published on the page https://ginza.gr/contact/ 4. In order to expedite the processing of the guarantee, please provide the name and contact details of the complainant as well as a description of the reasons justifying the complaint. 5. Neither the Service Provider nor its employees, authorized representatives and proxies are liable to the Recipient who is not a consumer, its subcontractors, employees, authorized representatives and/or proxies for any damages, including loss of profits, unless the damage was caused intentionally by them.

VI. TERMINATION OF THE CONTRACT AND CHANGE OF THE REGULATION

1. The Recipient may at any time and without giving any reason unsubscribe from the Newsletter service (unsubscribe from the service), in particular by clicking on the deactivation link in each email sent to the Recipient within the framework of the Newsletter service. 2. The Service Provider may terminate the Contract at any time with one month’s notice for important reasons that are considered as (closed list):

a. change of the legal provisions regulating the provision of electronic services by the Service Provider, which affect the mutual rights and obligations set out in the Agreement or change the interpretation of the above provisions as a result of court decisions or recommendations of offices or organizations appropriate for the specific sector, b. change in the way of providing services exclusively for technical or technological reasons (in particular, updating the technical requirements referred to in this Regulation) c. change of the scope or provision of services to which the provisions of the Regulation apply, by introducing new, modifying or withdrawing from the Service Provider the existing functions or services covered by the Regulation.

3. The Service Provider’s statement with the content specified in paragraph 2 above is sent to the email address provided by the Recipient when registering for the Newsletter service. 4. The Service Provider may terminate the Agreement with seven days’ notice or deny further rights to use the Newsletter service as well as restrict access to some or all of the content referred to in point IV above, for important reasons, e.g. serious violation by the Recipient of this Regulation, i.e. in cases where the Recipient of the service (closed list) violates the provisions of point II, par. 6, letter c, d of the Regulation. 5. The Regulation is the contractual standard within the meaning of the provisions on consumer protection (Government Decree 5338/2018, Government Gazette B’ 40/ 17-1-2018). 6. The Service Provider may change these Regulations in the event of at least one of the following important reasons (closed list):

a. change of the legal provisions regulating the provision of electronic services by the Service Provider, which affect the mutual rights and obligations set out in the Agreement or change the interpretation of the above provisions as a result of court decisions or recommendations of offices or organizations appropriate for the specific sector, b. change in the way of providing services exclusively for technical or technological reasons (in particular, updating the technical requirements referred to in this Regulation), c. change of the scope or provision of services to which the provisions of the Regulation apply, by introducing new, modifying or withdrawing from the Service Provider the existing functions or services covered by the Regulation.

7. In the event of a modification of the Regulation, the Service Provider will make available a single text of the Regulation by publication on the Website and via messages sent to the e-mail address provided by the Recipient of the service when subscribing to the Newsletter service. 8. The modification of the Regulation shall enter into force 14 days after the date of sending information about the change. The Recipient of the service has the right to terminate the Agreement within 14 days from the date of notification of the change of the Regulation.

VII. FINAL PROVISIONS 1. The Agreement is concluded in the Greek language. 2. The consolidation, security and access to essential provisions of the Agreement are carried out by sending an electronic message to the electronic address provided by the Recipient of the service when registering for the Newsletter service. 3. The applicable law to the Agreement is Greek law and the Greek courts, unless otherwise provided in the mandatory legal provisions.
